Workers’ compensation deadlines in Montana
The Montana State Fund (MSF), which administers the state’s workers’ compensation system, has strict deadlines when it comes to applying for workers’ compensation benefits. Some of them most important deadlines include:
- 30 days after the first occurrence of your work-related injury or illness, you must notify your employer or your employer’s insurance company that you were hurt on the job. You can notify them verbally or in writing. We strongly suggest doing so in writing.
- 12 months from the date of your work-related illness or injury, you must submit a written First Report of Injury (FROI) form to your employer, your employer’s insurance company or the Montana Department of Labor & Industry (DLI).
- 30 days after you submit your signed FROI form, your employer’s insurance company must either accept or deny your workers’ compensation claim.
- There is no set deadline for appealing a denied workers’ compensation claim in Montana, but it’s always best to appeal your denied claim as soon as possible. The same is true if you believe you deserve more money than your initial workers’ compensation claim. You can appeal that decision and request additional money.
