Options available when appealing a denied claim
Your employers’ insurance company has 30 days to accept or deny your application for workers’ compensation benefits. Officially, they will be acting on your First Report of Injury (FROI) form for workers’ compensation benefits. You must submit your written FROI form to your employer, your employer’s insurance company or the Montana Department of Labor & Industry (DLI).
If your employer’s insurance company denies your FROI application form – or if you believe you are entitled to receive more workers’ compensation benefits –the following legal options are available to you:
- You can discuss your dispute with your employer or your employer’s insurance company. We can help you with this step, in which both sides can sometimes resolve their differences.
- You can ask Montana’s Employment Relations Division to mediate your dispute. An impartial mediator can facilitate discussions between yourself and your employer’s insurance company.
- You can file a Petition for Hearing with Montana’s Workers’ Compensation Court. We can represent you at such court hearings and work with you to build the strongest possible legal case.
- You can ultimately file an appeal with the Montana Supreme Court if necessary. The state Supreme Court can then decide whether to uphold the Compensation Court’s decision or overrule it.
There is no formal deadline for appealing a denied workers’ compensation claim in Montana. The sooner you start the process, however, the sooner you can hopefully receive the financial compensation you rightfully deserve.
